Action: Post our “99% – Guy Faux Mask” Signs (Very Dramatic Red-Black Design) placed atop thousands of candidate signs around town. There are ~4 signs to choose from… mix and match. Try to do at least a hundred each in your own neighborhoods.

Who: Individually or in Groups, on your own schedule. Try to do as many as possible prior to the Weekend before the election Nov 6. Please spread the word! It’s easier and quicker w two people but I’m doing fine alone too.

Where: Wherever there are clusters of candidate signs on public property, e.g., at busy intersections, around polling places, along roads.. SEE Legal NOTES below & prev email Candidate signs within 3 feet of street are not legally protected by law

How: Suggest using clear shipping tape. My experience glue sticks (not waterproof) or with spray cans- is not good. Brushed thick liquid can be OK only if it gets tacky quickly. Test whatever you want to try at the store.

Materials: Print out these jpeg files downloaded from link provided there are 8.5″x11″ and 8.5×14 ones you like.. .JPEG files at an office store and get them run off in color (~$.40 ea). Recommended: Clear shipping tape

Leverage: Out target is the Voter. We expect this will be our highest exposure event in Raleigh and other cities. This is part of a Solidarity Action with Oakland. This particular 99% sign action is being announced nationally. The mission in this is not to tell people what to think, but rather “To Make Them Think” about their utter dissatisfaction w the status quo (baby steps to true peoples government). We hope you can make this into a spectacle event that belies our true numbers.

Larger intention is to Change Our Broken Democratic System which locks us into a two party system allowing money to control who the viable candidates are… regardless of obtaining the required signatures to run for any office. In a country that purports to serve all it’s citizens it is we the people who must prescribe who should be running, not corporate interest and money. Only then does our vote count.

Signs should be printed out or copied In COLOR for effect, and stuck on existing candidates signs along roads, at polling places, intersections. good luck and have a lot of fun. If you like this action and decide to do it pls let me know… take pictures too and send them!! This can really be dramatic when many in a row are viewed.

Begin asap and have a batch in your car so do ad hoc also. Have fun! call me with comments or stories.

Be frugal put our signs on candidate signs that can be well seen, where many are in a row so as to gather attention. possibility of news media picking this up as an election spectacle because it can be dramatic.

Secure your paper completely on existing sign rather than hanging it off the edge. Practice at home. Take a damp rag.

Keep in mind that OUR signs are legal “political” signs under this law which refers to placement. Candidate Signs placed within 3 feet of pavement (d-2 below) are not protected under this law.

Here is a statute enacted into law and signed by the Governor last year that applies to political signs placed on the right of way of the State highway system.

Note that Subsection (d) regulates sign placement and provides that “No sign shall obscure or replace another sign.”

Note that Subsection (e) provides: “It is a Class 3 misdemeanor for a person to steal, deface, vandalize, or unlawfully remove a political sign that is lawfully placed under this section.”

A Class 3 misdemeanor is the lowest level of misdemeanor carries a maximum fine of $200 and a maximum jail time of 1-10 days with no prior conviction, 1-15 days with 1 to 4 prior convictions, and 1-20 days with 5 or more prior convictions.

AN ACT TO PERMIT CAMPAIGN SIGNS IN HIGHWAY RIGHTS-OF-WAY WITH REASONABLE TIME, PLACE, AND MANNER RESTRICTIONS.

The General Assembly of North Carolina enacts:

SECTION 1. G.S. 136-32 reads as rewritten:
Ҥ 136-32. Other than official signs prohibited.Regulation of signs.

(a) Commercial Signs. – No unauthorized person shall erect or maintain upon any highway any warning or direction sign, marker, signal or light or imitation of any official sign, marker, signal or light erected under the provisions of G.S. 136-30, except in cases of emergency. No person shall erect or maintain upon any highway any traffic or highway sign or signal bearing thereon any commercial advertising: or political advertising, except as provided in subsections (b) through (e) of this section: Provided, nothing in this section shall be construed to prohibit the erection or maintenance of signs, markers, or signals bearing thereon the name of an organization authorized to erect the same by the Department of Transportation or by any local authority referred to in G.S. 136-31. Any person who shall violate any of the provisions of this section shall be guilty of a Class 1 misdemeanor. The Department of Transportation may remove any signs erected without authority. authority or allowed to remain beyond the deadline established in subsection (b) of this section. th

(b) Compliant Political Signs Permitted. – During the period beginning on the 30 before the beginning date of “one-stop” early voting under G.S. 163-227.2 and ending on the 10th day after the primary or election day, persons may place political signs in the right-of-way of the State highway system as provided in this section. Signs must be placed in compliance with subsection (d) of this section and must be removed by the end of the period prescribed in this subsection.

(c) Definition. – For purposes of this section, “political sign” means any sign that advocates for political action. The term does not include a commercial sign.

(d) Sign Placement. – The permittee must obtain the permission of any property owner of a residence, business, or religious institution fronting the right-of-way where a sign would be erected. Signs must be placed in accordance with the following:

(1) No sign shall be permitted in the right-of-way of a fully controlled access highway.

(2) No sign shall be closer than three feet from the edge of the pavement of the road.

(3) No sign shall obscure motorist visibility at an intersection.

(4) No sign shall be higher than 42 inches above the edge of the pavement of the road.

(5) No sign shall be larger than 864 square inches.

(6) No sign shall obscure or replace another sign.

(e) Penalties for Unlawful Removal of Signs. – It is a Class 3 misdemeanor for a person to steal, deface, vandalize, or unlawfully remove a political sign that is lawfully placed under this section.

(f) Application Within Municipalities. – Pursuant to Article 8 of Chapter 160A of the General Statutes, a city may by ordinance prohibit or regulate the placement of political signs on rights-of-way of streets located within the corporate limits of a municipality and maintained by the municipality. In the absence of an ordinance prohibiting or regulating the placement of political signs on the rights-of-way of streets located within a municipality and maintained by the municipality, the provisions of subsections (b) through (e) of this section shall apply.”
